The concept of “substances of concern” (SoCs) has become increasingly central in EU chemicals and product policy, particularly following its introduction in the EU Chemicals Strategy for Sustainability. While initially framed as a strategic concept, it is now being operationalised across a growing number of legislative instruments. This evolving concept goes beyond the traditional focus on substances of very high concern (SVHCs) under REACH, as it encompasses both Hazard-based SoCs and Circularity-based SoCs. As a result, the scope of regulatory attention is expanding significantly, both in terms of substances covered and sectors impacted.
However, despite its increasing relevance, the concept of SoCs remains non-uniform across EU legislation. Therefore, it creates legal uncertainty and practical challenges for industry, particularly as supply chains become more interconnected and products increasingly serve multiple uses across sectors.
