General Terms and Conditions (GTC)

The following General Terms and Conditions shall apply to conferences, congresses and seminars, the ordering of documentation, as well as to exhibiting and sponsoring.

1. Scope

The following General Terms and Conditions shall govern the contractual relationship between the event participant/exhibitor or the party ordering conference documentation and Akademie Fresenius GmbH. General Terms and Conditions issued by the participant and/or his/her company shall not be deemed applicable.

2. Services

a) Conference and Training Participation (Face-to-face and Online)

All attendance fees for our face-to-face events are calculated on a per-person, per-event basis and are subject to the statutory rate of value-added tax. The fees include detailed event documentation, lunch, coffee breaks and beverages during the conference as well as an evening event, insofar as the latter has been planned as part of the respective event programme. Accommodation and the cost of any other meals not included within the scope of the conference shall be borne directly by the participant who shall accordingly settle all accounts related hereto directly with the hotel.

All attendance fees for our online events are calculated on a per-person, per-event basis and are subject to the statutory rate of value-added tax. The fees include the participation in the online event and detailed event documentation for download.

The topics and agenda of an event, as well as the assignment of the guest speakers, may be altered providing that the general nature and character of the said event are maintained. Akademie Fresenius GmbH is entitled to cancel an event as a result of force majeure or if there is good cause (e.g. illness of several guest speakers or an insufficient number of participants); in this event, any payments submitted shall be reimbursed in full. Participants shall receive immediate notification in such an event. Participants shall have no legal claim to the reimbursement of travel and/or accommodation expenses or to compensation for the loss of working hours. Akademie Fresenius GmbH reserves the right to change the conference programme if there is good cause.

b) Sponsoring/Exhibiting

The scope of services included when booking an exhibition package shall be specified in a separate confirmation document. In addition, the provisions outlined in 2a) shall apply accordingly.

c) Ordering Conference Documentation

The conference folder price quoted is subject to the statutory rate of value-added tax and encompasses the full conference documentation, including postage and packaging (also to destinations outside Germany) as well as access to the secure download area on our website. Conference documentation cannot be ordered for evaluation purposes, i.e. all orders shall be legally binding. The dispatch of the documentation is usually effected around two weeks subsequent to the event. Dispatch shall only be effected once payment of the invoice has been received in full.

For our online events, access to the event documentation is purely electronic via the secure download area on our website.

3. Payment/Cancellation/Changes to Bookings

The amount payable shall be remitted without deductions two weeks after receipt of the invoice, at the latest prior to the day on which the event commences.

Free cancellation or rebooking for our face-to-face events is possible in writing up to four weeks before the start of the event. After this point in time and up to a week before the start of the event, we will refund 50% of the participation fee. In the event of later cancellations or no-shows, no participation fees can be reimbursed. You can name a substitute participant at any time free of charge.

For our online events, you can cancel your registration in writing up to 1 week before the start of the event free of charge and without giving reasons. In the event of later cancellations and failure to log in to the online event, no participation fees can be reimbursed.

In this case, however, you will receive access to the event documentation from us after the event.

4. Copyright

All documentation pertaining to our events is protected by copyright. Participants and/or parties ordering conference documentation are solely granted a simple, non-transferable right of usage for their own personal use. In particular, participants and third parties are not permitted to make editorial changes – in whole or in part – to the conference documentation, to copy it for third parties or make it available to the general public, to sell it to others or to use it for commercial purposes.
All copyrights pertaining to oral presentations as well as to presentations included in the conference documentation shall remain with the respective authors.

Akademie Fresenius GmbH holds the copyright to the overall conference documentation. The copying, reproduction or any other usage of the conference documentation as well as the taking of photographs or making of audio or video recordings during the event is only permissible upon prior consent by Akademie Fresenius GmbH.

5. Right of Revocation for Consumers

As a private consumer you have the right to revoke all contracts (registrations, orders etc.) closed with Akademie Fresenius within fourteen days without stating reasons.

The period of withdrawal is fourteen days starting on the day the contract is closed.

To exercise your right of withdrawal, you have to inform us (Die Akademie Fresenius GmbH, Alter Hellweg 46, 44379 Dortmund, freseniusakademie-fresenius.de) by issuing a clear statement (e.g. letter sent by post or email) of your decision to withdraw from the contract closed with us.

In order to preserve the withdrawal period, it is sufficient that the notification of the execution of your right of withdrawal be dispatched prior to the expiry of the withdrawal period.

In the case that you withdraw from this contract, we shall reimburse all payments received from you without delay and at the latest within fourteen days starting on the day on which we received the notification of your withdrawal from the contract. For this reimbursement we shall use the same payment method that you used for the original transaction, unless otherwise expressly agreed; in any event, no fees shall be charged to you for said reimbursement.

Should you have requested that services begin during the withdrawal period, you shall pay us an appropriate amount in proportion to the extent of the services already provided up until the time of informing us that you intend to exercise your right of withdrawal with respect to the closed contract in comparison with the full scope of the services provided for in the contract.

6. General Provisions

The place of jurisdiction and the place of performance shall be Dortmund, unless otherwise specified in writing.
