General Terms and ConditionsThe following General Terms and Conditions shall apply to conference and/or exhibition-related bookings, sponsoring arrangements as well as orders pertaining to conference documentation. 1. Scope The following General Terms and Conditions shall govern the contractual relationship between the conference participant/exhibitor or the party ordering conference documentation and Akademie Fresenius GmbH. General terms and conditions issued by the participant/exhibitor or his/her company shall not be deemed applicable. 2. Services a) Conference Participation All prices quoted for conference participation are calculated on a per-person, per-conference basis and are subject to German VAT. The price specified includes detailed conference documentation, lunch, coffee/tea breaks and beverages during the conference as well as an evening event, insofar as the latter has been planned as part of the respective conference programme. Accommodation and any other associated costs not specified within the scope of the conference shall be borne directly by the conference participant who shall accordingly settle all accounts related hereto directly with the hotel. The topics and internal schedule of an event, as well as the assignment of the guest speakers, may be altered providing that the extent and general nature and character of the said event are maintained. Akademie Fresenius GmbH is entitled to cancel an event as a result of force majeure or if there is good cause (e.g. illness of several guest speakers or an insufficient number of participants); in this event, any payments submitted shall be reimbursed in full. Participants shall receive immediate notification in such an event. Participants shall have no legal claim to the reimbursement of travel and/or accommodation expenses or to compensation for loss of working hours. Akademie Fresenius GmbH reserves the right to change the conference programme if there is good cause. b) Sponsoring/Exhibiting The scope of services included when booking a sponsoring/exhibiting package shall be specified in a separate confirmation document. In addition, the provisions outlined in 2a) shall apply accordingly. c) Ordering Conference Documentation The Conference Folder price quoted is subject to German VAT and encompasses the full conference documentation, including postage and packaging (also to destinations outside Germany). Conference documentation cannot be ordered for evaluation purposes, i.e. all orders shall be legally binding. The dispatch of the documentation is usually effected around two weeks subsequent to the event. Dispatch to destinations outside Germany shall only be effected once payment of the invoice has been received in full. 3. Payment/Cancellation/Changes to Bookings The amount payable shall be remitted without deductions two weeks after receipt of the invoice, at the latest prior to the day on which the event commences. Cancellations and changes to bookings must be made in writing and are free of charge four weeks prior to the day on which the event commences. In the case of cancellations made subsequent to this deadline and up to one week prior to the day on which the event commences, a total of 50% of the fees shall be reimbursed. In the case of cancellations made after the aforementioned deadline, the full amount shall be payable. You may designate a substitute at any time at no extra cost. 4. Copyright/Proprietary Right The copyright/proprietary right attributable to oral presentations and written documentation shall remain with the speaker/author. Akademie Fresenius GmbH holds the copyright to the overall conference documentation. The copying, reproduction or any other usage of the conference documents as well as taking photographs or making audio or video recordings during the conference is only permissible upon prior authorisation by Akademie Fresenius GmbH. 5. General Provisions The place of jurisdiction and the place of performance shall be Dortmund, unless otherwise specified in writing. As of 1 January 2004 |
